Revocation of DROP Enrollment

Since May 2002, members have been offered the opportunity to revoke participation in DROP within seven calendar days of submitting their DROP Application Form.  The City Attorney recommended a review of this policy in light of the fact that the potential existed to have a revocation period extend beyond the DROP entry effective date. On August 4, 2011, the Board of Fire and Police Pension Commissioners approved policy recommendations to provide consistent administrative practice for DROP revocation.

 

New DROP Revocation Policy 

  1. Applicants will have through the day prior to their DROP entry effective date to submit a DROP Revocation Notice to the Department of Fire and Police Pensions (LAFPP).  The Notice must be turned into the LAFPP office in person before the close of business at 5:00 p.m., or if faxed, no later than 11:59 p.m.

  1. The effective date of revocation is established upon receipt and signature thereon, by LAFPP administrative staff.
  2. It is the member’s responsibility to ensure timely receipt of the Notice by LAFPP.
  3. Failure to submit the DROP Revocation Notice binds the member to the DROP agreement and participation in DROP.

 

When does this go into effect?

 

The Board approved this policy on August 4, 2011.

 

How is this considered “consistent administrative practice?”

The potential for revocation periods existing beyond the DROP entry date will be eliminated.  Furthermore, the policy now codifies existing practice:  a Plan member may apply to enter DROP no earlier than 30 days prior to their intended DROP entry effective date.  (Currently, service pensions can be revoked through the day prior to the service pension effective date.)

 

Where do I get a DROP Revocation Notice?

 

You should receive a copy of the new DROP Revocation Notice during your counseling session beginning November 23, 2011.
